Premium IPTV Australia respects the intellectual property rights of others and expects users of our service to do the same. This DMCA Policy describes how we handle copyright infringement claims and outlines the process for submitting notices and counter-notices in accordance with the Digital Millennium Copyright Act (DMCA) and applicable Australian copyright law (Copyright Act 1968).
1. Our Commitment to Copyright Compliance
We take copyright infringement seriously and are committed to responding promptly to notices of alleged infringement. If you are a copyright owner or an authorised representative and believe that content accessible through our service infringes your copyright, you may submit a DMCA takedown notice using the procedure described below.
We operate in compliance with the Australian Copyright Act 1968, the DMCA (17 U.S.C. § 512), and international copyright treaties to which Australia is a signatory.
2. Reporting Copyright Infringement
To submit a valid DMCA notice of copyright infringement, your written notification must include:
- Your physical or electronic signature (or the signature of an authorised representative).
- Identification of the copyrighted work(s) you claim have been infringed, or a representative list if multiple works are involved.
- Identification of the specific content you believe is infringing, with sufficient detail for us to locate it (e.g., specific URL, channel name, or VOD title).
- Your contact information including full legal name, postal address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the copyright owner’s behalf.
Send DMCA notices to:
- Email (preferred): dmca@premiumiptvaustralia.com
- General support: support@auiptv.org
- Contact form: premiumiptvaustralia.com/contact.html
We process DMCA notices within 2 business days of receipt. Valid, complete notices will result in prompt removal of the identified content from our service.
3. Consequences of a Valid DMCA Notice
Upon receiving a valid DMCA takedown notice, we will:
- Remove or disable access to the identified infringing content within 48 hours.
- Notify the user whose content was removed (if applicable) that a DMCA notice has been received.
- Provide the user with information about the counter-notification process.
- Maintain records of all DMCA notices received and actions taken as required by law.
4. Counter-Notification Procedure
If content you believe is not infringing has been removed following a DMCA notice, you may submit a counter-notification. A valid counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your full name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, for users outside the US, any judicial district in which we may be found).
Send counter-notifications to: dmca@premiumiptvaustralia.com
Upon receipt of a valid counter-notification, we will forward it to the original complainant and may reinstate the content within 10–14 business days unless the complainant obtains a court order to prevent reinstatement.
5. Repeat Infringer Policy
In accordance with the DMCA, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. Accounts found to repeatedly infringe copyright will be permanently terminated without notice and without refund. We define a “repeat infringer” as any user against whom we have received two or more valid, uncontested DMCA notices.
6. Abuse of DMCA Process
The DMCA provides that any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability. We reserve the right to seek damages and legal costs against any person who submits abusive, fraudulent, or knowingly false DMCA notices or counter-notifications.
7. Australian Copyright Law
In addition to the DMCA process above, copyright complaints relating to Australian content may also be submitted under the Australian Copyright Act 1968. The Australian Copyright Council (copyright.org.au) and the Australian Communications and Media Authority (ACMA) are the relevant Australian regulatory bodies for copyright and broadcasting matters. We cooperate fully with Australian authorities in copyright matters.
